Website Terms and Conditions

1. About these Terms

This website is provided by Liva Law & Associates (羅瑞華律師事務所) ("Liva Law", "we", "us" or "our"). These Terms apply to your access to and use of this website, including its articles, guides, frequently asked questions and downloadable materials.

Please read these Terms before using the website. If you do not agree with them, please stop using it.

These Terms are not terms of engagement for legal services. They do not replace or amend any engagement arrangements separately agreed with us.

2. Website content is not legal advice

The content of this website is for general information only. It is not legal advice to any person or organisation, or on any particular matter, and is not a substitute for professional advice on your specific circumstances.

Unless otherwise stated, legal and regulatory content concerns Hong Kong. Content may be summarised or simplified and may not cover every exception, procedural requirement or subsequent development. We do not guarantee that every page is complete or up to date.

You should not make decisions, take action or delay dealing with a matter solely on the basis of this website. References to cases, procedures or possible outcomes do not indicate that any particular matter will have the same outcome.

3. Website use does not automatically create an engagement

Simply browsing this website, downloading materials, submitting an enquiry or contacting us by email, telephone or WhatsApp does not, by itself, create a solicitor–client relationship.

We normally complete the necessary conflict-of-interest and client identification checks before confirming in writing whether we accept an engagement and its scope, fees and other terms. Until you receive confirmation, do not assume that we have accepted your matter or agreed to take action on your behalf.

This section does not exclude any duty arising under applicable law, professional rules or our actual conduct.

4. Enquiries, confidential information and urgent matters

At first contact, please provide only your name, safe contact details and a brief description of the matter without sensitive details.

Do not send regulatory notices, investigation documents, legal advice or other confidential, legally privileged or disclosure-restricted information until we have confirmed that we can receive it and agreed with you how it should be sent.

Electronic communications may be delayed, misdirected or affected by security risks. These Terms do not require you to waive any applicable confidentiality protection or legal professional privilege, or release us from any duty of confidentiality imposed by law.

Do not assume that a solicitor has read your message, or that we have agreed to monitor or meet any deadline, merely because you have submitted an enquiry or received an automated acknowledgement. If your matter is urgent, seek prompt legal assistance rather than relying on an online response. Existing clients should use the communication arrangements agreed with us.

5. Personal data and privacy

Please read our Privacy Policy and any relevant Personal Information Collection Statement provided when we collect your data. These explain how we collect, use, retain and disclose personal data.

These Terms do not replace those documents. We will not treat your use of this website or acceptance of these Terms, by itself, as consent to receive direct marketing.

6. Intellectual property and use of content

Unless otherwise indicated, intellectual property rights in the website's content, design and branding belong to us or the relevant rights holders.

You may view, download or print content provided by us for personal reference or internal business reference, provided that you retain copyright and source notices and do not modify or use the content in a misleading way.

Other copying, republication, distribution, adaptation or commercial use requires prior written permission from us or the relevant rights holder, unless permitted by applicable law.

You may share links to publicly accessible pages of this website, but must not imply that we endorse, support or are associated with you.

7. Acceptable use

You must not use this website for unlawful activities, impersonate another person, submit information you are not entitled to disclose, or infringe another person's rights.

You must not interfere with the website's operation, introduce malicious software, bypass security measures or attempt to obtain unauthorised access to the website or related systems.

8. Third-party websites and services

This website may link to third-party websites, official materials or communication services. A link does not mean that we endorse the third party or all of its content.

We do not control third-party websites or services. Please review their own terms and privacy policies before using them.

9. Website availability and limitations of liability

We do not guarantee that the website will always be available, error-free or free from harmful software. You should take appropriate precautions to protect your devices and data.

To the extent permitted by applicable law, and subject to any applicable requirement of reasonableness, we are not liable for loss arising from your use of, or inability to use, this website or your reliance on its general information.

Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any liability or right that cannot lawfully be excluded or limited.

The limitations in this section concern website use only. They do not limit our duties as your solicitors when we accept an engagement.

10. Changes to the website and these Terms

We may update the website and these Terms from time to time. Revised Terms will be published on this page with an updated date and will apply to subsequent website use. They will not retrospectively amend agreed engagement arrangements.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

11. Governing law and jurisdiction

These Terms and disputes arising out of or relating to your use of this website are governed by the laws of the Hong Kong Special Administrative Region.

Subject to any non-excludable statutory rights or mandatory legal requirements, you and we submit to the non-exclusive jurisdiction of the Hong Kong courts.

12. Language versions and contact

These Terms are available in English, Traditional Chinese and Simplified Chinese. If there is any inconsistency between the language versions of these Terms, the English version prevails to the extent permitted by applicable law.

If you have questions about these Terms, please contact us using the details on our Contact section.
